I had resolved for 2023 that I would spend less time nattering about the various trials and tribulations of the State Bar of California. A good resolution in theory, but it’s just not going to work, especially after the latest headline story in the Los Angeles Times about how the discipline system in this state is a joke. And it is.

The headline makes it clear that the discipline system goes after minority attorneys, especially Black lawyers. That’s not news for us lawyers, but it is for the public. And some of the charges are technicalities, not major violations such as stealing client funds. In the almost 30 years between 1990 and 2018, a study released by the bar three years ago showed that Black male lawyers were nearly four times likelier to be either disbarred or resign with charges pending. Safe to say US District Judge Donald Middlebrooks is tired of Donald Trump’s bullshit. The South Florida jurist just got through the first round of sanctioning Trump’s lawyers in that garbage fire RICO suit against Hillary Clinton and James Comey. And now New York Attorney General Letitia James removed that insane complaint Trump filed against her in Palm Beach County Circuit Court to federal court, landing on his docket.

Surely Trump’s new lawyers from the St. Petersburg law firm Weber Crab Wein will be on their best behavior, lest they find themselves on the pointy end of a Rule 11 motion. Right?

In anticipation of the a scheduling conference tomorrow in the E. Jean Carroll suits against Donald Trump, the parties submitted a proposed discovery plan last night. The plaintiff would like to schedule this trial for April, while the defendant would like to calendar it for never.

This is an unsurprising position from Trump, who spent years trying to avoid this lawsuit by evading process, claiming presidential immunity from civil suits, removing to federal court, and even substituting the government as defendant on the theory that defaming a woman as too ugly to rape was part of his job as president. Thanks to the Second Circuit, the issue of whether Trump was acting within the scope of his official duties is now in the hands of the DC Court of Appeals.
